Terms of Service

These Terms of Service ("Terms") govern your use of the Perch mobile application and related services (collectively, the "Service") operated by Perch ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. Description of Service
Perch is a passive home-monitoring service that reads data from smart home sensors installed in a residence to help caregivers understand the daily routines of aging loved ones. The Service analyzes motion and activity patterns and sends alerts when anomalies are detected.
Perch is not an emergency response service. It does not replace 911, medical alert systems, or professional in-home care. Perch provides informational alerts only — it does not guarantee detection of emergencies, falls, or medical events.
2. Eligibility
You must be at least 18 years old to use Perch. By using the Service, you represent that you have the legal authority to agree to these Terms.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to keep it up to date.
4. Consent and Monitoring
You represent that you have obtained appropriate consent from the person whose home is being monitored, or that you have legal authority to monitor the residence (e.g., as a legal guardian or authorized caregiver). You are solely responsible for ensuring compliance with all applicable laws regarding monitoring and data collection in the monitored person's jurisdiction.
5. Acceptable Use
You agree not to:
- Use the Service to monitor anyone without their knowledge or appropriate legal authorization.
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
- Use the Service for any unlawful purpose.
- Share your account credentials with unauthorized third parties.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
7. Service Availability
We strive to keep Perch available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.
8. Limitation of Liability
To the fullest extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not warrant that alerts will be timely, accurate, or comprehensive.
- In no event shall Perch be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
9. Account Termination
You may delete your account at any time from Settings > Delete account within the app. We may suspend or terminate your account if you violate these Terms or if required by law. Upon termination, your data will be deleted in accordance with our Privacy Policy.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Continued use of Perch after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.
